13. Dispute Resolution
13.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Website (a "Dispute") informally by contacting Costa Vida at [email protected]. We will attempt to resolve the Dispute informally within thirty (30) days of receiving your written notice. If we are unable to resolve the Dispute informally within that period, either party may proceed with formal dispute resolution as described below.
13.2 Binding Arbitration
If informal resolution is unsuccessful, any Dispute that cannot be resolved through negotiation shall be resolved by binding individual arbitration, rather than in court, except as provided below. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this arbitration agreement.
The arbitration shall be conducted by a recognized arbitration organization such as the American Arbitration Association (AAA) in accordance with its then-current Consumer Arbitration Rules, or such other arbitration organization as mutually agreed upon by the parties.
